Legal Skills Training Class -- Bankruptcy Paralegal


Introduction


This class will provide you with a basic set of legal skills that will allow you to market yourself as a Bankruptcy Paralegal, charging $35.00 an hour to fill out forms under the Bankruptcy Code.



In addition to the core, the class has two additional modules. The first is general legal skills, to help you learn and understand general legal concepts and the general skills necessary to be an independent paralegal.



The second is alternative dispute resolution, with a focus on Mediation. This module will train you with the skills necessary to be a peacemaker and a mediator.



You should expect that the useful skill, that you can market and use to build a business, will be the Bankruptcy Paralegal skill. The general legal skills class is intended to help you with the necessary background to be successful using those skills. The alternative dispute resolution skills class, with a forty hour focus on mediation, will teach you useful life and other skills.



You will learn the same skills being taught in commercial seminars on mediation and that have been responsible for some substantially successful careers. Be warned that opportunities in the mediation field may be limited, but also be aware that the skills are useful and positive.

Course Outline and Structure



This course extends for a four month period. The first two modules, the paralegal skills and how to use them, will take the first four months and need to be taken together. The last module, the mediation skills training, will take a month and is optional.





Bankruptcy Paralegal



Week One



What is bankruptcy?

What is a paralegal?

Visit to the bankruptcy court building. Observe proceedings.



Week one is not intended to introduce the students to the goal that they will have -- handling matters in bankruptcy as a paralegal.



Week Two



Introduction to the Independent Paralegal concept. (Book 4, chapters 1-4).



Week Three



Continue with Independent Paralegal concept (Book 4, finish book. This book will be returned to, so that the "once over" approach to finishing the book will be revisited).



Week Four



Introduction to Bankruptcy (Book 2, chapters 1-3)



Week Five



More on Bankruptcy (Book 2, chapters 4-6, review Book 3 -- form kit).



Week Six



Finish Bankruptcy overview (finish Book 2).

Practice with forms (teach how to photocopy forms, work through filling out forms).



Week Seven



Revisit the Independent Paralegal.

Go through additional form work.



Week Eight



Marketing Without Advertising (chapters 2, 3, 4 -- the personal recommendation method, the importance of physical appearance, setting and explaining pricing).



Week Nine



Introduction to Legal Research. (Book 7). Visit Small Business Administration with class.



Marketing Without Advertising (chapters 9, 8, 11 -- helping customers find you, how to let customers know your business is excellent, designing and implementing your marketing plan).



Week Ten



More on Legal Research. (Book 7)



Chapter 13 (Book One -- two classes reviewing it, tell class members that it is a resource that they can use for future needs).



How to Disagree (Chapters 1,2,3)



Week Eleven



Review forms, practice forms.



Revisit Independent Paralegal Handbook.



How to Disagree (Chapter 4)



Week Twelve



Review and practice forms.



How to Disagree (Chapter 6, 8, 9).



Break (may be set at different times, depending on schedule).



Final Week (close first two modules).



Review what an independent paralegal is, how to market an independent paralegal, and check skills with forms.



Trip to Courthouse.



Pre-Graduation (close of module one and two, part one).





Part Two



Week One



Create a business plan as a bankruptcy paralegal and work towards implementing it.



Forms, access to photocopy machine, access to typewriter or acceptable handwriting skills. Place to work, place to meet with potential clients (rooms in courthouse, meeting rooms in library, in front room of home, etc.).



How to get paid. When to get paid.



Plan on marketing.



Week Two



Create a marketing plan as a bankruptcy paralegal and work towards implementing it.

Practice marketing plan. Practice asking for money, not working if not paid.

Week Three



Practice handling each other as customers (role-play, interview, fill out forms).

Repeat and repeat.



Also review and practice principles in Legal Research: How to Find & Understand the Law.



Week Four



Work on business and marketing plans. Check for problems that have come up and questions.



More practice, trouble shooting, and role-plays.





Week Five



Specific issues focuses. Set up group as mutual support/mutual mentoring group (so that they can meet once a week and discuss marketing, issues in filling out forms, techniques and solutions).

What is mediation and what is ADR?

NITA book chapters 2-3



Week Two



NITA book chapters 3-4

Review forms in Chapter 5.

Practice role-plays in chapter 6.



Week Three



MCS book, chapter 4, A-C

MCS book, chapter 4 D



Week Four



MCS book, chapter 5



Week Five



Roleplays, MCS book, chapter 8.

Enclosed is the basic outline for a class, complete with the books that would go into making the class work. (The books marked with an asterisk are books I currently do not have).



If you would like, and if you let me know the class schedule (how long the classes are, etc.), I would be glad to put together lesson plans and related materials for you to put a class together.



I would ask that you buy a copy of the books for yourself and that you send me a set of the current editions of the books I do not have. Also, let me know the level of detail that you need the lesson plans, etc. to be in. (The level of detail will control how long it will take to flesh this out. I've done everything from scripted classes, word for word, to outlines with less detail that the one I'm sending you, depending on the needs of the organization the lessons were prepared for).
