The following is a mediation nightmare that a person encountered.  How would you advise them?


Subj: My Mediation Nightmare

Dear Mr. Marsh,

What recourse do I have if I was bulldozed in my divorce mediation? At the end of those 12 hours, I was sobbing, I couldn't talk, I couldn't comprehend the complexity of the way they laid out my life and my lawyer now tells me she would never let a client in my shape sign the agreement again...what next?

What are my chances to have it set aside? Please help me.


Can she sue the mediator for fraud or overreaching?  Her attorney for malpractice?  Her self for trusting them? Can she do anything?  Should she do anything?
